In consideration of the subscription fee as set out in the referring documents:

The Company will:
1) authenticate users and provide the PeddleGold container code
2) maintain a record of users of said container code with the referring URL.
3) maintain said container code in merchantable condition.

The Applicant will:
1) use any number of instances of PeddleGold running from one domain by one user.
2) provide a minimum 30 day notice upon cancellation of the Company services.
3) accept automatic quarterly billing except in cases of cancellation
4) provide complete and accurate Subscriber information during the registration process

LIMITATIONS AND MODIFICATIONS:
1) Limitation of liability:  The Company will not be liable for damages sustained by the Applicant either directly or indirectly, resulting from failed access experienced by the Applicant when using the Company services, nor from loss of business and profits incurred by the Applicant. The Company's sole liability for service failure will not exceed the then current billing amount prorated for service provided.
2) Termination:  The Company can suspend and/or terminate service without notice when found that the Applicant engages in serious and gross misconduct damaging to the Company services or in violation of the terms of this agreement.
3) Modification:  The Company reserves the right to modify the terms of service at any time and at its sole discretion. Any change adversely affecting the Applicant will be preceded by sufficient advance notice to allow the Applicant adequate time to cancel services without penalty.
3) Subscription fees:  The Company reserves the right to change the fees charged for subscriptions at its sole discretion. Any change adversely affecting the Applicant will be preceded by sufficient advance notice to allow the Applicant adequate time to cancel services without penalty.
